He said that with the rapid development of artificial intelligence technology, challenges and conflicts in law, security, employment, ethics and government governance have become increasingly prominent. the development of artificial intelligence in China has formed unique advantages

in recent years, artificial intelligence technology, as a strategic technology and core driving force leading the fourth industrial revolution, has become a hot spot of international attention. The United States, the European Union, Japan, South Korea and other countries and regions have made forward-looking layout around the new generation of artificial intelligence technology and industrial development. In response to the globalization of artificial intelligence, China has successively issued the three-year action implementation plan for "Internet +" artificial intelligence, the national scientific and technological innovation plan for the 13th five year plan and the development plan for a new generation of artificial intelligence to strengthen the guidance of industrial development

"China has made important progress in the field of artificial intelligence research and development. The number of international scientific papers published and the number of invention patents authorized has ranked second in the world. the conflict between the development of artificial intelligence technology and the existing legal rules highlights

"the rapid development of artificial intelligence technology has also brought unprecedented challenges to the current ethical standards, legal rules and social order." In Yang Jie's view, the conflict between the development of artificial intelligence technology and the existing legal rules has been highlighted, mainly in five aspects:

first, the challenge of artificial intelligence to the qualification of legal subjects. Robot is the main form of artificial intelligence composite products. How to look at the legal status of robot and examine its existing rights and obligations is a very important legal issue. With the emergence of more intelligent robots, it is necessary to explore more about the legal status of robots

second, the challenge of artificial intelligence to the protection of personality rights. First, personal privacy protection. In the field of biometrics, especially in the field of image recognition, speech recognition and automatic decision-making based on knowledge map, the problem of personal privacy protection is particularly prominent because it involves the collection and use of a large number of user data. fourth, the challenge of artificial intelligence to data security. Among the three core elements of artificial intelligence: core algorithm, data resources and computing power, the legal issue of data security has a long history. Yang Jie stressed that how to ensure the security of national data when acquiring and processing massive data information including government, enterprises, finance, medical care and other aspects is a major practical issue that needs to be considered urgently in AI legislation

fifthly, the protection of intellectual property rights by artificial intelligence, but how to check it? Generally, most of the challenges are caused by improper use and incorrect installation methods. On the one hand, we should pay attention to the intellectual property protection of software and hardware standards, codes and other technologies related to artificial intelligence; On the other hand, we should pay attention to the identification and ownership of intellectual property rights of music, paintings, poetry and other works "created" by intelligent robots

"at present, there are no laws and regulations on the R & D, production and use of artificial intelligence in China, and the regulations with high relevance to the artificial intelligence industry are mainly concentrated in the field of network security and data protection." Yang Jie believes that accelerating the promotion of artificial intelligence legislation is an important embodiment of the implementation of the central government's strategic deployment of comprehensively ruling the country by law, an important aspect of strictly implementing the national artificial intelligence development strategy, an urgent need to promote the benign development of the artificial intelligence industry, and an inevitable choice for China to participate in the international governance of artificial intelligence. He suggested that we should speed up the legislation of artificial intelligence according to the current development situation of artificial intelligence and China's national conditions

first, plan AI legislation at the national level. First, set up a special AI legislative body at the national level. Strengthen the leading role of the government, strengthen the concept of the overall situation and systematic thinking, make overall planning and promote in a coordinated manner, so as to lay an organizational foundation for carrying out specific industry legislation. Secondly, universities and research institutions should be supported to carry out forward-looking scientific and technological legal research, such as the analysis of legal issues related to the application of artificial intelligence, such as civil and criminal confirmation, privacy and property protection, information security interests, etc., so as to provide theoretical support and intellectual input for the establishment of artificial intelligence norms and systems

second, legislative consideration should be carried out by classification and stages. Yang Jie believes that we should focus on strengthening the protection of intellectual property rights in the field of artificial intelligence, explore the establishment of compulsory insurance and compensation fund systems, establish a traceability and accountability system for artificial intelligence, increase the punishment for data abuse, invasion of personal privacy, algorithm traps and other acts, quantify the classification of artificial intelligence levels, limit the application scope and research fields of specific levels of artificial intelligence, and promote sound development

the third is to deepen the international cooperation on the transfer and maintenance of artificial intelligence. First, when formulating our laws and regulations, we should strengthen international cooperation, learn from each other's strong points and complement each other's weak points. At present, governments, industries, researchers, non-governmental organizations and other stakeholders in various countries have preliminarily explored and carried out the standardization and supervision work in the field of artificial intelligence. China should carry out extensive dialogue and continuous cooperation with relevant countries, learn from successful experience and promote complementary advantages. Second, actively participate in the formulation of international rules and enhance the international voice in the field of artificial intelligence. "China should actively participate in 7. global governance in the field of simple artificial intelligence, strengthen research on major international common issues, set an example as a negative power, ensure that technological innovation operates on the track of the rule of law and on the basis of recognized international norms, strive to take the initiative and participate in and lead the formulation of international rules."
